Data Retention

Cohen Family Law will retain all documents and records in either physical or electronic form for a minimum period of 11 years from the date of the last substantive exchange with the client on the matter. This is in compliance with our own legal and professional obligations.

Records may be destroyed without client consent after 20 years from the last material event on the file.

Data Security

We take the security of your personal data seriously and have implemented appropriate technical and organisational measures to protect it from unauthorised access, loss, misuse, or alteration. These measures are in line with the Law and include:

  • Secure storage using reputable platforms such as Microsoft 365, Legl and Clio, which provide encrypted environments and robust access controls.
  • Access restrictions ensuring only authorised personnel with a legitimate need can view your data, all of whom are bound by professional and legal confidentiality obligations.
  • Encryption, password protection, and secure devices to safeguard data during storage and transmission.
  • Regular backups and secure server environments with fire detection and response systems to prevent data loss or destruction.
  • 3rd party safeguards, including data processing agreements with service providers to ensure they meet our data protection standards.

While we strive to protect your data, please note that internet transmission is not completely secure, and any data you send to us online is at your own risk. Once received, we apply strict procedures to prevent unauthorised access.

In the event of a suspected data breach that poses a risk to your rights and freedoms, we will notify you and the Jersey Office of the Information Commissioner (JOIC) without undue delay and within the required timeframes.
